CTF Refunds Client Agreement

1. Introduction
This agreement (“Agreement”) is between you (“the Client”) and CTF Refunds, a trading style of Taxbax Ltd (“the Company”, “we”, “us”). By signing our online claim form, you agree to the terms set out below.
2. Services
The Company will use reasonable endeavours to locate your Child Trust Fund (“CTF”) by submitting a Data Subject Access Request (“DSAR”) to HMRC and, once the fund provider is identified, will assist you in accessing the funds held in your CTF account.
3. Service Fee
- Our success fee is 30% plus VAT of the total value of the fund recovered.
- The maximum fee payable is capped at £999 inclusive of VAT, regardless of the fund value.
- No Payout, No Fee: If we are unable to locate your fund or you do not receive any money, you owe us nothing.
4. Cooling Off Period
You have a 14-day cooling off period from the date you sign this agreement. During this period you may cancel the agreement without charge by contacting us in writing at info@ctfrefunds.co.uk or by telephone.
5. Client Responsibilities
- You confirm that all information provided to us is true, accurate, and complete to the best of your knowledge.
- You agree to provide any additional documentation we may reasonably request in order to progress your claim, including but not limited to proof of identity and proof of address.
- You confirm that you are the rightful owner of the CTF account being searched for, or the legal guardian acting on behalf of the account holder.
6. Payment Terms
- Payment of the success fee becomes due within 30 days of you receiving your CTF funds from the provider.
- Payment will be collected via Direct Debit using our payment partner, GoCardless.
- Late payments may incur an administrative charge of £50. If payment remains outstanding after 60 days, the debt may be referred to a collections agency.
7. Authority to Act
By signing this agreement, you authorise the Company to act on your behalf in contacting HMRC, fund providers, and any other relevant parties for the sole purpose of locating and recovering your CTF.
8. Data Protection
We will process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your data will be used solely for the purposes of locating and recovering your CTF and will not be shared with unrelated third parties. You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us.
9. Limitation of Liability
- The Company does not guarantee that your CTF will be located or that any funds will be recovered.
- Our total liability to you is limited to the amount of fees you have paid to us under this agreement.
- We are not liable for any indirect, consequential, or incidental losses arising from our services.
10. Termination
Either party may terminate this agreement by providing written notice to the other party. If you terminate after the cooling off period but before the claim is complete, no fee is payable unless we have already successfully located your fund and provided you with the provider details. In such case, the full success fee remains payable.
11. Governing Law
This agreement is governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction over any disputes arising from this agreement.
